Hi Mike,

I'm not sure either what the FCC reg is but from
personal experience they can come down on you pretty
hard if your misalignment causes problems for a legal
service.  One of my responsibilities at the College is
our satellite service.  We are considered government
so we aren't commercial.  

Just before I came to work at the College one of our
employees pointed our uplink dish at the wrong bird. 
I think the interference lasted about two minutes
before he realized he was on the wrong bird.  Several
days later we got a formal letter from the FCC asking
for a detailed explanation of what we did.  After our
response we received a formal letter warning us that
the next event could cause a fine and forfeture of our
license.  We were also slapped on the hand since the
employee aiming the dish was not licensed.

I'm not quite sure what the power is of these data
systems and even whether they would bother other birds
but there are enough of them up there that I wouldn't
attempt to do any transmission unless I was qualified
or licensed to do this type of setup.  They have ways
to find you.  Especially dependent upon who you are
interfering with.
