Thats what has happened to mine over the years. If you notice the support
for the bottom step has probably created a small indention on the top step
therefore causing it to tilt downward instead of staying square. To remedy
this I found that by placing a small metal object in this area where the
step support hangs solved the problem. I use two short nails in the 16 penny
type, Lock the top step in place and then fold down the bottom step. Insert
the nails on both sides annd it should be square. When you fold up the
bottom step the nails will fall out, pick them up and put them in a
convenient place until the next time.

There is probably a more permanent solution but I have not had time to work
on it.
